Bury resident, Mr D, was walking to his partner’s house when he tripped and fell on a defective grid, causing him to land heavily on his right hand, fracturing his wrist.
Initially the local council denied responsibility for his accident and that they had a suitable system of inspection of the relevant pavement. We undertook further investigatory work which suggested the council were not in fact inspecting the pavement regularly and following that we placed pressure upon the council who then admitted liability.
We then obtained specialist expert medical evidence from an upper limb surgeon who reported that Mr D would probably suffer with permanent minor pain and stiffness because of the fracture.
Unfortunately the council then began to deny the accident occurred the way Mr D said it did (a common tactic of many local councils and their solicitors). However, we were able to obtain witness evidence from a number of family members to confirm his whereabouts at the time and then following a period of negotiations settlement was reached at over £38,000, with which Mr D was delighted.
