Lasting Power of Attorney (LPA)

Having an LPA allows you (donor) to pick someone you really trust (your attorney) to handle things like your money, property or health choices should there become a time when almost inevitably you can't make those decisions for yourself though accident, stroke, coma, old age or early onset dementia.

Without a Lasting Power of Attorney in place, if issues arise, you may find your life being controlled by Court of Protection appointed solicitors – paid for by you, involuntarily.  If you don’t make your choice in advance, the Court of Protection will.  So appoint those you trust, while you still have time.

Anyone over the age of 18 should have LPA's and there are two types:

Health and Welfare - allows you to appoint people you choose to make decisions about your health and personal welfare if you become unable to make those decisions yourself. This includes choices about medical treatment, where you live and who you have contact with.

Property and Financial Affairs - enables you to designate people you choose to manage your finances and property matters if you're unable to do so. This includes handling your bank accounts, paying bills, managing investments, and even selling property on your behalf.

You can choose more than one attorney and they can act together or separately. 

Business people - may well need two Property and Financial Affairs LPAs and company directors may need to amend their Articles of Association to avoid automatic removal from their directorship – crucial in single director businesses.

When can the attorney act?

Attorneys can only act when the LPA has been:

• signed by you and your attorney(s)
• certified by a certificate provider confirming that you understand the nature and scope of the LPA and have not been unduly pressured into signing it; and
• registered with the Office of the Public Guardian. Which currently takes nearly 5 months, so don’t delay/

If you chose top allow it, the Property & Affairs LPA can be used whether you have the mental capacity or not to make financial decisions for yourself. Ideal to reduce the burden without giving up control.

The Welfare LPA can only be used if you lack the mental capacity to make your own welfare or medical decisions.
