Many contracts contain a clause which says words to the effect that ;-
"any variations to this agreement must be in writing and signed by both parties " .
The Court has now held that if a contract contains such a clause , then any attempts to orally change the contract will be ineffective .
Whilst the decision provides certainty to the parties , it does mean that anyone wishing to vary a contract should ensure they do so strictly in accordance with the procedures laid down in the contract .
