In the case , a woman who described herself as an architect , agreed to advise her former neighbours and friends of 10 years on a landscaping project . There was no contract and she agreed to work free of charge , in the hope of being able to charge a design fee for a later stage in the project .
The Court held that she had assumed a duty of care and was responsible for her negligence .
Although it is an extreme example of the facts , it does highlight the dangers of giving free advice
