if you die without leaving a valid will , ( known as an intestacy ) the law sets out how your estate will be distributed.
From 6th February 2020 , when someone dies without leaving a will , their spouse will receive the first £270, 000 of the estate and half the remaining balance. The other half of the balance will be split between the children . If there are no children , then everything pases to the spouse.
if there is no spouse or children , the estate will pass to your parents, siblings or other family members.
However , the rules do not take into account modern relationships. Unmarried partners and step children are not entitled to inherit under the intestacy rules , although they may be able to make a claim under the Inheritance ( Provision for Family and Dependants ) Act 1975
Making a will is the best way to keep control of what happens to your estate .
